On August 18, the Obama Administration announced it will form a high-level task force and review the approximately 300,000 pending removal cases. The task force will identify and administratively close removal proceedings against individuals found to be a "low" enforcement priority. Administrative closure is not a dismissal or termination, it simply "deactivating and putting the case on a shelf for a substantial period of time." The review process, will be jointly conducted by members of both the Departments of Justice (Executive Office of Immigration Review) and Department of Homeland Security, is intended to ease the tremendous backlog in the immigration courts. It is also designed to ensure that government resources are focused on cases involving the government's highest immigration enforcement priorities-such as public safety, national security and border security.

This is not a change in the law. This is a change in policy and how the government wants to handle removal cases. This memorandum does not create a right or benefit for foreign nationals. American Immigration Lawyers Association recently released a state-by-state guide to filing complaints against notarios and "immigration consultants." These people prey on the vulnerable masses of immigrants who lack command of the English and legal languages used in the courts and benefits processes. Only a U.S. licensed lawyer or accredited representative is authorized and qualified to assist foreign nationals. Immigration law continues to evolve. Within the past two decades, there have been multiple overhauls to the system including but not limited to IMMACT90, IIRIRA, AEDPA and REAL ID 2005. Some of these have focused on aspects of law besides immigration and have collaterally impacted the immigration spectrum. The Obama administration has comprehensive immigration reform (CIR) on its agenda, but it is not at the top of the list. Our Opinion on Immigration Reform, Based on Our Experiences

Our fear is that the United States will become even more restrictive in the amount and type of visas the government issues. Unfortunately, most of the country is in a protectionist mindset and afraid about job security and terrorism. A more restrictive immigration quota system would further deter accomplished professionals, entrepreneurs and other intellects from immigrating to the United States. The U.S. already loses thousands of doctors, computer engineers, nurses and other needed professionals to other countries like Australia, Brazil and Canada because of restrictive immigration quotas that force foreign nationals working in the United States to wait as long as seven to ten years to get permanent resident status.

Our hope is for a complete overhaul of the quota system for family visas and professional and employment visas; visa quotas and country quotas should be increased and the application procedures should be streamlined. Additionally, we hope for changes to the deportation laws and procedures including the installation and use of the Federal Rules of Evidence and additional Due Process guarantees for foreign nationals.
