What Is a Temporary Visa?
Unlike permanent employment visas, temporary work visas provide short-term status for foreign national employees in the United States. These visas require foreign nationals to maintain an intent to return to their country of origin or depart the U.S. within a very specific period of time. Some of these visas allow for "dual intent," permitting the foreign national to apply for adjustment of status. The critical determination is which temporary visa is best for the foreign national and the company.
B-1 Business Visitors
A B-1 visa allows an individual to come temporarily to the United States for specific business purposes. Both foreign companies and U.S. employers need short-term visas for key people to enter the U.S., conduct business and depart timely. The regulations are very specific in the types of commercial activity permitted. Such activities include, but are not limited to:
- Participating in conventions, conferences or seminars
- Consulting with business associates
- Negotiating contracts
- Engaging in commercial transactions
H-1B Visas: Specialty Occupations
An H-1B visa is a nonimmigrant visa that allows an employer to hire a foreign national in a specialty occupation. This visa is generally available to individuals employed in specialized occupations. This is also a "dual intent" visa allowing a foreign national to pursue lawful permanent resident status while working on their H-1B. A person with an H-1B usually gets three years time with one three year extension. Certain educational and licensure requirements must be met.

High-level managers, executives and employees with specialized knowledge can utilize this type of temporary work visa to work in the U.S. This type of visa is a useful tool for many international companies to keep continuity in their workforces. L visas allow for "dual intent." These visas are available for persons who have worked abroad for their company for one continuous year (within the preceding three years) prior to being transferred to the U.S. A variation of this visa also allows for executives and managers to set up a new office of the foreign company in the U.S.
O Visas for "Extraordinary" Aliens
A foreign national who can demonstrate sustained national or international acclaim in the sciences, arts, education, business or athletics may be eligible for an O visa. These types of temporary work visas are excellent avenues of entry to the U.S. for high-end chefs, business people without high level degrees, entertainers and professional athletes. This is critical to those foreign nationals seeking to avoid the H or L visa track.
Trade NAFTA or "TN" Visas for Mexican and Canadian Citizens
TN visas are available for Mexican and Canadian citizens. There is no annual cap to the number of these visas issued. NAFTA designates 63 categories of professionals who may apply for and receive TN visas. This is especially important during times of H-1B visa shortages.
