Department of Homeland Security routinely detains aliens prior to and during deportation proceedings. Immigration and Customs Enforcement sets the bond amount based on the criminal and immigration history of the foreign national. If ICE determines a bond amount, most foreign nationals can seek a hearing before an immigration judge to lower the amount. If ICE determines that the alien was convicted of specific crimes, ICE will indicate the alien is not eligible for a bond. Aliens may appeal this determination in certain circumstances.
Bond Redeterminations
Aliens detained by ICE who have a monetary bond amount set, may ask an Immigration Judge to lower it. The Judge will review factors such as the alien's length of residence in the U.S., if the alien has relief from the deportation proceedings, the alien's risk of flight and the risk of harm to the community if released. Using the above factors, the Judge can lower the bond amount.
Mandatory Detention
Aliens convicted of certain crimes are not eligible for bond. Crimes of moral turpitude, aggravated felonies, and controlled substance violations are generally the basis for DHS to determine aliens are ineligible for bond. Aliens may appeal this determination by filing a Joseph motion before the immigration judge. If the alien is able to show the judge there is a "substantial likelihood" DHS will not prevail in removal proceedings, the judge can determine a bond amount based on the above criteria.
Ohio Cases
Aliens detained in the northern portion of Ohio are generally processed at Solon, Maple Hts., and Bedford Hts. jails. They are then moved to Seneca County Jail in Tiffin, Ohio. Again, aliens detained in Seneca County will have their cases heard by televideo with an immigration judge in Cleveland and should be represented by a Cleveland deportation defense lawyer. Aliens detained in Butler County Jail will have their cases heard via televideo with an immigration judge in Cleveland, Ohio. A Cleveland deportation attorney should be hired to represent and appear for aliens in these cases.
